1. Acceptance
These Terms & Conditions ("Terms") govern your access to and use of Museumica (the "Service"). By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.
2. Eligibility & accounts
You must be at least 16 years old to use the Service. You are responsible for the security of your account credentials and for all activity under your account.
3. Your content
You retain ownership of the specimens, photographs, descriptions and other content you upload ("Your Content"). You grant Museumica a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display and process Your Content solely to provide and improve the Service. When you mark content as public, you also grant a licence for visitors to view it as displayed on your public museum pages.
4. Acceptable use
You agree not to:
- Upload content you do not own or do not have the right to share.
- Upload illegal, infringing, defamatory or harmful content.
- Catalogue or trade specimens in violation of applicable law (including CITES, national wildlife and antiquities legislation).
- Interfere with, scrape, reverse engineer, or attempt to gain unauthorised access to the Service.
- Use the Service to send spam or unsolicited communications.
5. Plans, billing & cancellation
Paid plans are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
6. Intellectual property
The Service, including its software, design, branding and documentation, is the intellectual property of Museumica and its licensors. No rights are granted except as expressly set out in these Terms.
7. Termination
We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that risks harm to other users or to Museumica. You may close your account at any time from your account settings.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. Museumica does not guarantee uninterrupted availability, error-free operation, or that the Service will meet every requirement.
9. Limitation of liability
To the maximum extent permitted by law, Museumica's total liability for any claim arising out of these Terms or the Service is limited to the amount you paid for the Service in the twelve months preceding the claim. Museumica is not liable for indirect, incidental, consequential or punitive damages.
10. Indemnity
You agree to indemnify and hold Museumica harmless from claims arising out of Your Content, your use of the Service, or your breach of these Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Museumica is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
12. Changes
We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
